STEPS YOU SHOULD FOLLOW ONCE YOU HAVE DECIDED TO BUY A PROPERTY

Once you have decided to buy a property in Mexico, it is extremely important that you follow the necessary steps, for this I suggest that you contact us through any means and we will provide you with free personalized advice where we will indicate the entire process and the requirements that you must meet for this process.

CLOSING DOCUMENTS

Our role will be to collect and verify all the documents necessary to carry out the transaction.

 

We will provide assistance and accompaniment, the work of the notary public that we will select for you before closing will be reviewed.  Once all the investigation has been concluded and the necessary documentation gathered, we will proceed to execute the public deed of sale in which the property rights are transferred. This document guarantees the ownership of property either through a direct purchase or the constitution of a trust, which will be registered in the Public Registry of the State Government.

 

At this point the remaining closing expenses must be paid, this includes taxes for the acquisition of the property, fees.

 

All official documents issued by Mexico must be in Spanish, however, we will assist you with the translation verbally for your entire knowledge.  If you have any questions during the process, you can contact us directly to provide you with the solution.

POST SALE

Once the deed of sale is signed, Naylex will verify and validate that all taxes, duties, condominium fees and utilities are paid to date. According to Mexican law, the buyer’s rights can be challenged by a third party if the title has not been registered.

 

Our job is to verify to ensure that the title deed is correctly registered in the Public Registry of Government. We also provide title assurance by providing a certificate that the title is free of any mortgage. As a buyer you must receive a certified copy of the deed of the property. 6 Simple steps of
Naylex
to create a Mexican company

STEP 1.- PROVIDE GENERAL INFORMATION.

Your first step in creating a Mexican company is to fill in the details about your new company through our website. This information is necessary for the creation of the company and identifies a minimum of 2 shareholders as required by Mexican law.

 

Foreigners may be shareholders of the corporation and the law does not require any shareholder to be a Mexican citizen or Mexican resident.

 

We will also ask you to attach the documentation we need to create your company. Consider that Naylex uses maximum security decoding to ensure that your personal data is well protected. It is essential that the passport or document you provide to us is scanned.

STEP 2.- SEND YOUR PAYMENT TO NAYLEX.

Timely receipt of your payment allows us to move forward with the creation of your new Mexican company.

STEP 3.— REQUEST YOUR COMPANY NAME.

You will have the option to provide 3 (three) options of possible names for your Mexican company from which we will verify their availability. Names can be in English or any other language, and we suggest you get creative as the most common names are used. For example, if you want to choose Lindo Quintana Roo, you can add some initial number to have a better chance of obtaining it.

 

This process can take from 3 (three) to 5 (five) business days, once approved we will send you the corresponding certificate. If the 3 (three) names you provided were not approved, you may provide another 3 (three) possibilities.

 

Remember that the more creative you are, the greater the chances of getting it.

STEP 4.- CREATE THE DRAFT BYLAWS.

Once the name of the company has been approved, we will create a draft of the title of the company, you will have to provide us with the detailed activities that your company will perform, the more information you give us in STEP ONE, we can prepare the ideal document for you.

 

It is very important that at this point you decide who will be your administrator or accountant to obtain the FIEL before the SAT and allow who will pay your taxes.

STEP 5.- SIGNING OF THE TITLE OF THE COMPANY.

Once the company documents have been reviewed by all parties, we will sign the company title at one of our partner notaries. Please note that all partners must present themselves to Mexico to sign.

STEP 6-

It will be our obligation to register your company in the Public Registry of Commerce and in the National Registry of Foreign Investment. We will also obtain your company’s Mexican tax ID, known as an RFC and your company is ready to trade!
